Father Who Assaulted And Impregnated 11-Year-Old Daughter Will Avoid Prison

Parents are meant to protect and keep their children safe, not take advantage of them. Children trust and rely on their parents and this trust should never be broken. Michael Joe Adkins broke his 11-year old daughter’s trust when he sexually assaulted and impregnated her, then took her for an abortion.

Guardians Michael and Amanda Adkins were both charged with cases of child neglect

The West Virginia case has been ongoing since October 2010 when Michael Adkins first began raping his daughter. His abuse continued and after his daughter turned 12 she became pregnant. Michael and the girl’s stepmother tried to cover up the sexual assault by taking the girl to an abortion clinic. After the abortion, they took her to get a D&C (dilation and curettage), which is a medical procedure sometimes necessary after a miscarriage or abortion. Michael and Amanda Adkins were both charged with cases of child neglect causing a risk of injury. Michael was also charged with incest and first-degree sexual assault. While Amanda has pled guilty, her case is temporarily delayed as details are finalized for Michael’s case.

Michael will not be incarcerated

Despite Michael’s crime, he will not be incarcerated. According to The Herald Dispatch.com,  Michael will receive no jail time due to a plea bargain. He will only receive five years of probation and 50 years supervision after the five years are up. In addition, he will also have to register as a sex offender and get therapy. However, the punishment is not suitable for the terrible crime he committed against his daughter.

Cabell Circuit Judge Paul T. Farrell insisted on the additional 50 years supervision. “I’m just going to be blunt: I hope you screw up during those 50 years, so I can send you to prison,” he said. “If you violate any of the terms and conditions in the next 50 years, then the court can send you to prison – and I’m hoping that’s the case because you should go to prison for what you did.”

The abortion clinic failed to report the case of incest

Not only did the abortion clinic administer the abortion on the child, but they also failed to report the case of rape and incest to the police. After the abortion, the parents took the girl back to the doctor who was working with the investigators and told him that their daughter was experiencing symptoms of a miscarriage. Unaware of the girl’s true circumstances, the doctor then gave her an unnecessary D&C procedure and unknowingly put her at risk. That is where the charge of neglect creating a risk of injury comes in. The girl was put under anesthesia and had an unnecessary medical procedure. Her parents failed to take care of her needs and lied to cover up the incest.
